Photographic evidence of blocking the easement

We have hundreds of images demonstrating the blatant blockade of an easement that I helped to establish 44 years ago. The easement document was created and recorded to share a 24 foot wide by 180 long easement where the 2 properties join together. The original owner of the TCR property was the SuperShop. They needed the easement because without it their building footprint would be much smaller. The entire 4th bay would not exist. Years later Discount Tire purchased the property.

During the 30 plus years SuperShop and Discount Tire occupied the property, blocking the easement never occurred. When TCR took over they enclosed their entire back parking lot. They built a fence with gates and razor wire. Since then, no customer parking is provided in the back anymore. In addition, they only have 4 parking spaces up front. This has caused TCR customers and their vendors to rely on Hogie House parking.

When you provide plans to the city you must show you have adequate parking spaces to support a business. If you don’t have enough spaces available, you have a major problem. TCR does not have enough parking.

It’s bad enough they lack parking. Now in addition they block the easement. They also park vehicles next to the sidewalk in a no parking zone. This creates a dangerous situation when you attempt to enter or exit the property.

This image shows the TCR dumpster in the easement on the ingress side. In the morning, they move the dumpster from a position further back in the easement to this location closer to the front of the property which is also in the easement.

I’m parked at the end of the easement which is 180 feet from the front. The property is 280 feet deep leaving approximately the last 100 feet with no easement. You can see the TCR vehicles and dumpster are clearly blocking the easement.

The easement has been blocked every day for the last 3 plus months Monday through Friday (TCR is closed Sat & Sun). There is a truck parked in a Hogie House parking space. Notice how little room there is to back up when you are exiting the parking space.

In this image TCR is completely blocking the ingress and the egress. The vendor exited the truck and left it there for 30-45 minutes (also seen on video). When you block the ingress and the egress no one can enter or leave the back of the property.

Another day, another easement blockade. Notice that the 2 vehicles are in the ingress but they are both facing north toward Speedway. This means they turned the vehicles around or backed them into the easement. This proves they intended to park here.

In addition to the dumpster, cars and trucks, they also place campers, trailers and boats in the easement.

Here’s a photo taken from inside the Hogie House looking out at the easement. If you are coming on to the property from Speedway, as soon as you turn to come in, that 2nd white truck with a camper shell is very close to the street.

Here they are blocking the easement against the building and unloading a towed vehicle in the egress side of the easement.

As you can see, the easement is blocked and the ingress is restricted forcing all incoming traffic to use the egress (Hogie House side). Over time this is going to cause a lot of wear and tear to the HH side.

This is another problem that is important to note. It also creates issues with the parking lot. There are 2 trucks parked next to the sidewalk at the edge of the easement. This is not a parking area. There is one legal space to the left in the image. When these trucks are parked here, which is very often, it is near impossible to exit the property safely. When you reach the end of the egrees to exit onto Speedway, you can’t see the oncoming traffic in the right lane. It’s just a matter of time before a serious accident happens due to this issue. Months ago when I asked Andrew to remove a vehicle from the easement, I was told he was going to park up front next to the sidewalk to block out our Hogie House sign and put us out of business.

This first video is from June 17, 2024. This is around 8am before we open. The TCR employee is using a small fork lift to move their dumpster from the current location (it’s in the easement), to a location closer up in the easement where you see it in all of the photos. Every day they play this game. Move the dumpster in the morning, put it back at closing time. Whether the dumpster is next to their north gate, or up against the building it is always in the easement. To not be in the easement it has to be moved inside their yard or south of the metal poles I installed in the NON-EASEMENT south 100 feet. You can see one of the employees checking or making a minor adjustment to a vehicle. To be honest, I don’t make a big deal out of something like this as long as he’s not doing an oil change.


This is one of the participants of the Easement Blockade. I assume he was instructed to park in the easement as soon as he arrives at work each morning. He is usually the first to arrive and that truck stays there all day long. Even if no other TCR vehicle joins him, TCR customers and vendors assume it’s ok to park here.

This is why it is critical to install no parking signs on the side of the building and on the metal fence north of the TCR north gate. Even if TCR stops the blockade, they have already established it’s ok for customers and vendors to park here. The signs are essential.

Now we see a TCR vendor park in the easement and with paperwork in hand grab a part from his truck. Most likely he does not even know he is blocking the easement since the dumpster and truck are already blocking the ingress. Again, signs are required.


In this video we see Andrew Soto the owner of TCR helping a customer in the Hogie House parking lot. I have nothing against this situation. None of my parking spaces are marked “HH Customers Only”. I welcome our customers and his customers to use the customer parking in this manner. As long as they don’t leave a vehicle there for an extended time I’m not making an issue with this behavior. In the beginning of the video you see Andrew look around like he is doing something wrong. The only thing that is wrong Andrew is the truck and dumpster behind you in the easement!


Here’s a good example of a Hogie House customer struggling to get out of a parking space with a blocked easement. Thankfully there was no vehicle in the parking space on the passenger side. The customer makes a 3 point turn to enter the easement, drives to the back of the property to make another 3 point turn and then drives north on the egress to get to Speedway.

Let’s do some more work in the easement.

Once a week we receive an order from Shamrock Foods. Their drivers are excellent. They take care in leaving room for others while they unload. This delivery was made on 7/3/24. He parked, unloaded and left in under 14 minutes.  The easement was blocked by TCR yet our driver still left our side of the easement open.

It’s bad enough they block the easement and park next to the sidewalk creating dangerous situations for customers, pedestrians, motorists and the general public. In this video you see the first truck speed in using the egress to enter their yard. Then a moment later you see the dark truck drive backwards through the egress also entering their yard.
